Condannati i vertici della fondazione per la "messa in libertà" dei dipendenti
"Comportamento antisindacale" Il ricorso scaturì dalle trattenute per il "Faust" saltato
Nel teatro dei veleni si celebra una nuova puntata della guerra tra sindacati e sovrintendente. Secondo il tribunale, il Massimo ha tenuto «una condotta antisindacale»: il presidente della Fondazione, il sindaco Diego Cammarata, e il sovrintendente Antonio Cognata sono stati condannati a pagare 1.500 euro di spese processuali. A loro il giudice ha ordinato di «astenersi dal ripetere siffatta condotta». Ecco quanto stabilito Gianfranco Pignataro, giudice del lavoro, pronunciandosi sul ricorso presentato dalle organizzazioni sindacali che si erano opposte alla decisione del teatro di mettere preventivamente in libertà tutti i lavoratori in occasione della messa in scena del "Faust" con Andrea Bocelli. Una pronuncia che ricalca quella di Bologna dove a essere condannato è stato l´ex leader della Cgil Sergio Cofferati. Un´altra batosta per l´equilibrio del teatro, già sconvolto dall´aggressione a Cognata, picchiato da due sconosciuti sotto casa ad aprile scorso, e dalle nuove minacce: una busta con tre proiettili.
Il 20 marzo il "Faust" di Gounod non andò in scena per lo sciopero nazionale sui tagli al Fondo per lo spettacolo. Ma due giorni dopo, domenica 22 marzo, saltò anche la replica per la rottura del dialogo tra le organizzazioni dei lavoratori e il sovrintendente Cognata. In occasione della proclamazione dello sciopero nazionale, il consiglio di amministrazione aveva infatti deliberato la messa in libertà di tutti i lavoratori che partecipavano all´opera-concerto. Di fatto, dunque, nessuno avrebbe ricevuto la giornata di paga. «Deliberando la messa in libertà 24 ore prima del Faust Cognata non ha permesso ai lavoratori di scegliere se aderire o no allo sciopero», denunciarono Slc-Cgil, Fistel-Cisl, Uilcom-Uil e Fials Cisal. Una posizione condivisa dal giudice, che nella sentenza scrive che «la Fondazione sul solo rilievo che gli scioperi in questione sono stati indetti da quattro organizzazioni sindacali, e che ad esse aderisce oltre la metà degli aderenti all´orchestra, ma senza ulteriori indagini circa il prevedibile numero di effettive adesioni allo sciopero, già il giorno precedente ha disposto la messa in libertà di tutti gli orchestrali impegnati nell´esecuzione dello spettacolo, senza quindi accertare, né poterne dare la prova, la sussistenza in concreto della postulata inutilizzabilità della prestazione anche degli eventuali lavoratori non scioperanti».
Una decisione che secondo il giudice «non ha nemmeno consentito ai singoli lavoratori di esprimere o meno il proprio consenso all´astensione, depotenziando in radice l´effetto dello sciopero e finendo per annullarne la portata». Il comportamento della Fondazione quindi ha assunto «una valenza lesiva della libertà di azione sindacale». Il giudice del lavoro ha accolto dunque i ricorsi presentati dagli avvocati Roberto Croce, Piero Vizzini, Guido Lo Meo e Alfredo Sigillò, ma la Fondazione Teatro Massimo annuncia che farà ricorso.
I sindacati cantano vittoria: «Finalmente viene riconosciuto quanto da noi più volte sostenuto – dicono Angela Biondi, Cgil, Francesco Assisi, Cisl, Giuseppe Tumminia, Uil, e Fausto Patassi della Fials Cisal – l´assenza di corrette relazioni sindacali. Adesso attendiamo che il sindaco e Cognata ci convochino per mettere un punto rispetto agli atteggiamenti del passato». Ma il vice presidente Giuseppe Dell´Aira annuncia che il cda impugnerà di certo la sentenza: «Ci siamo comportati come avrebbe fatto qualunque altra fondazione lirica e abbiamo tutelato il pubblico danaro e gli interessi degli spettatori».
La cancellazione del Faust ha provocato un danno di quasi 200 mila euro: centomila euro per i cachet degli artisti e almeno 80 mila euro di mancati incassi.
